HABLAMOS ESPAÑOL
If you're looking for a car accident lawyer in Miami who explains things clearly, in English or Spanish, you're in the right place. I'm Juan Mendez Babani, licensed to practice law in Florida since 2015. I was born in Mexico, grew up in Miami Beach, and I work with my clients personally.
After a crash you're dealing with pain, doctor visits, a damaged car and calls from insurance companies. My job is to handle the legal side so you can focus on getting better.
Free consultation. If we take your case, there is no fee unless you recover money. You may be responsible for certain case costs, depending on your agreement.
Why this is personal for me
My uncle, attorney Alberto Babani, was my mentor. He was killed in a car accident caused by the gross negligence of a tire company. I know what it's like for a family to get that news, and what comes after. That's why I treat every accident case seriously and with respect for what you're going through.
What to do in the first hours after a car accident in Miami
-
Call 911. Florida law requires reporting right away a crash with injuries, or with damage that appears to be $500 or more.
-
Get medical care within 14 days, or you can lose your PIP medical benefits. Go even if you feel okay; many neck and back injuries show up later.
-
Take photos and video of the cars, tags, the scene, traffic lights and your injuries.
-
Get the other driver's name, phone, license, tag and insurance.
-
Write down witnesses and ask about nearby cameras. Video gets erased fast.
-
Don't give a recorded statement to the other driver's insurance before talking to a lawyer.
-
Don't post anything about the accident on social media.
How a car accident claim works in Florida
1. Your own insurance (PIP) pays first. Florida is a no-fault state. Your PIP usually pays 80% of reasonable medical bills and 60% of lost income, up to $10,000, no matter who caused the crash. If a doctor doesn't find an emergency medical condition, the medical limit drops to $2,500.
2. Then the at-fault driver's insurance. If your injury is permanent or serious, you can claim against the driver who caused the crash: medical bills PIP didn't pay, lost income, and pain and suffering.
3. If the other driver didn't have enough insurance. Florida doesn't require most drivers to carry bodily injury coverage, and many don't. If you have uninsured motorist (UM) coverage, it can help. We review your policy with you.
4. Shared fault. What you recover is reduced by your share of fault. If you're found more than 50% at fault, you usually can't recover from the other driver. That's why photos, witnesses and the police report matter so much.
Where we help
Our office is in Aventura. We handle car accident cases across Miami-Dade, including Miami, Hialeah, Doral, Kendall, Westchester, Little Havana, Miami Beach, North Miami, North Miami Beach, Aventura, Sunny Isles and Homestead, plus Broward (Hollywood, Hallandale Beach, Fort Lauderdale, Pembroke Pines, Miramar) and Palm Beach. If you can't come to the office, we can talk by phone, video or WhatsApp.
The crash report and calls you didn't ask for
For the first 60 days, a Florida crash report is generally available only to the people involved, their lawyers and their insurers. If someone you don't know calls or visits you right after the accident to offer a lawyer or a clinic, be careful. You decide who you talk to.
How much does a car accident lawyer in Miami cost?
The consultation is free. If we take your case, we charge a percentage only if you recover money. Florida Bar rules limit that percentage. Before you sign, we explain in writing the percentage, the costs and your rights as a client.
Frequently asked questions
How long do I have to file a claim after a car accident in Miami?
For most accidents after March 24, 2023, Florida law gives 2 years to file a lawsuit. To use PIP, you must get medical care within 14 days. Don't wait.
The accident wasn't my fault. Why is my insurance paying?
Under Florida's no-fault system, your PIP pays the first part of your medical bills and lost income. The claim against the at-fault driver is separate, if the injury qualifies.
Do I need a lawyer if the insurance company already offered me money?
You don't have to hire one, but once you sign a release you usually can't ask for more, even if your injury gets worse. Talk to a lawyer before you sign.
I'm not a citizen. Can I still make a claim?
In general, people injured in Florida can make a claim regardless of immigration status. What you tell your lawyer is confidential.
I was a passenger. Can I make a claim?
Often yes, against the at-fault driver, and sometimes more than one. Your PIP, or the PIP of the car you were in, may also apply.
Do you speak Spanish?
Yes. Juan speaks with his clients directly in Spanish, with no interpreter.
Do I have to come to the office?
Not necessarily. We can talk by phone, video or WhatsApp.
